They govern your use of xpresssmogcenter.com (the "Site") and the features offered through it: the forms, the call-back panel and Ozzie, our chat assistant. Please read them. Agreement to these Terms Using the Site means visiting any page, sending a form, using the call-back panel or chatting with Ozzie. Each of those is your acceptance of these Terms as they read on that day. If you use the Site on behalf of a business, you confirm that you have authority to accept these Terms for that business, and "you" includes the business. ## 2. Definitions In these Terms: - "Site" means xpresssmogcenter.com and every page, tool, form and email that comes from it. - "Location" means either of our two Reno smog check locations listed in section 3. - "Ozzie" or "the chat assistant" means the automated chat window on the Site, built by YelloPost AI. - "Content" means the text, images, photos, logos, data, code and design of the Site. - "YelloPost" means YelloPost, the Reno, Nevada agency that builds and operates the Site for us. ## 3. About us Xpress Smog Check Center is a Nevada smog check (emissions inspection) business located inside Xpress Oil & Lube Center, a locally owned company that has served Northern Nevada since 1983. We test vehicles at two Reno locations: Reno Northwest at 6100 Mae Anne Ave, Reno, NV 89523, (775) 787-1000, and Reno South at 4993 Longley Ln, Reno, NV 89502, (775) 828-6996. Our mailing address for notices under these Terms is 4993 Longley Ln, Reno, NV 89502. No appointment is needed at either location; you can [drive in](https://xpresssmogcenter.com/drive-in/). Hours for each location are posted on its [location page](https://xpresssmogcenter.com/locations/) and on its Google listing; hours can change on holidays, so call ahead if you are driving a distance. ## 4. Using the Site You may use the Site for its purpose: to learn about Nevada smog checks, find a location, ask us a question or ask for a call back. You must be at least 13 to use the Site and at least 18 to make an inquiry on behalf of a business. In using the Site you agree not to: - Give us false information or use someone else's email address or phone number. - Send spam, sales pitches, bulk messages or anything unlawful, threatening or abusive through the forms, the chat or the call-back panel. - Use automated tools to scrape, crawl, copy or harvest the Site or its data, other than search engines indexing public pages under our robots rules. - Try to get around the bot check, the rate limits, the duplicate guard or any other security measure, or probe the Site for weaknesses. - Upload malware or anything that could harm the Site, our servers or other visitors. - Load the Site in a frame on another site, or copy its Content onto another site, without our written permission. - Use the Site to collect information about other people. - Pretend to be us, our staff or YelloPost. - Use the Site in any way that breaks a law or someone else's rights. We may limit, suspend or block access to the Site for anyone who breaks these rules, without notice. ## 5. The information on the Site is general The Site describes how Nevada smog checks work in general: which vehicles and areas are tested, what to bring, what a failed test means and how registration fits in. It draws on public sources such as the Nevada DMV, cited on the page. It is not advice about your particular vehicle and it is not legal advice. Nevada's emission control rules, the areas that require testing, the exemptions and the DMV's requirements change from time to time. The Nevada DMV's website (dmv.nv.gov) is the authority, and we update the Site when we learn of a change. Where the Site and the DMV differ, follow the DMV. Where the Site and the result of your test differ, the test result governs. Which services each location performs can change. A phone call to the location or your visit is the only confirmation that a service is available that day. ## 6. Service at the locations The Site is not a booking system. Nothing on the Site or in the chat reserves a time or commits a location to a result or a charge. When you drive in, the location tests the vehicle and gives you the result. The paperwork you receive at the location is the record of the work and the charge. A smog test reports what the vehicle's emissions equipment and the test show on that day. We do not promise that any vehicle will pass. Whether a vehicle passes depends on the vehicle, not on the Site. Optional registration renewal at the station sends the renewal information to the Nevada DMV, which decides the outcome. The DMV's rules and fees apply to that transaction. Charges for work at a location are set and confirmed at the location, and any third-party figure quoted on the Site is that source's figure, cited on the page, not ours. Work done at a location is subject to Nevada law and the rules of the Nevada DMV Emission Control Program, and your rights under them are not reduced by these Terms. ## 7. Ozzie, the chat assistant Ozzie is an automated assistant built for us by YelloPost AI. It can answer general questions about smog checks, hours and our locations and take your name and number for a call back. It is not a technician and not a person. Its answers can be incomplete, out of date or wrong, and nothing it says is a promise about price, availability, timing or the result of a test. For anything that matters, call the location or drive in. You agree not to use the chat to send spam, abuse or unlawful content, not to try to make Ozzie say things it is not meant to say, and not to share sensitive information in it. Conversations may be reviewed by us and by YelloPost so that a person can follow up and improve the assistant, as the Privacy Policy explains. We may change, limit or remove Ozzie at any time. The Site, the forms and the phones work without it. ## 8. Forms, the call-back panel and messages When you send a form or ask for a call back, you agree that we may contact you about your request by phone or email at the details you gave, and that the message, the page it came from and basic technical details are sent to the location and to YelloPost as the Privacy Policy describes. Sending a form does not create an appointment, a hold or an obligation on either side; it is a request to talk. We try to answer every request during location hours, but we cannot promise a response time. If you need an answer right away, call the location. Forms are protected by a bot check, a hidden field and rate limits. If a form will not send, call either location and we will take the request by phone. ## 9. What you send us Anything you send us through the Site that is not personal information about you, such as a suggestion, a comment or a description of a problem, may be used by us without obligation to you. We will not publish your name with it without your permission. Reviews you post on Google belong to that platform's terms. We may quote a public Google review on the Site with the first name and last initial shown there. If you would like a review of yours taken off the Site, tell us and we will remove it from the next build. You agree not to send us anything that you do not have the right to send, including other people's personal information or copyrighted material you do not own. ## 10. Our intellectual property The Site and its Content are owned by the company or by YelloPost, which built the Site and its code and chat assistant for us, and are protected by copyright and trademark law. The names Xpress Smog Check Center, Xpress Oil & Lube and Xpress Oil & Lube Center and our logos are our marks. We give you permission to view the Site, print or save pages for your own personal use, and share links to pages. You may not copy the Site's design, code, photos or text for use elsewhere, remove copyright notices, or use our name or logo in a way that suggests we endorse something we do not. Third-party marks that appear on the Site, such as vehicle makes, Google and Cloudflare, belong to their owners. Their appearance describes compatibility or a link, not endorsement. If you believe something on the Site infringes a copyright you own, email ian@xpressoilandlube.com with the work, where it appears on the Site, your contact details and a statement that you believe in good faith the use is not authorized. We will look into it and remove material that should not be there. ## 11. Links to other sites The Site links to Google Maps, Google listings and reviews, the Nevada DMV and other sources we cite. Those sites belong to other organizations. We do not control them, we are not responsible for their content, accuracy, availability or privacy practices, and a link is not an endorsement. Use them under their own terms. ## 12. Availability and changes to the Site We may change, add to or remove any part of the Site at any time, including services listed, locations' hours and features. The Site may be unavailable for maintenance or for reasons outside our control. We do not promise that the Site will always be available, error-free or current. ## 13. No promises about the Site's content The Site and everything on it are provided as is and as available. To the fullest extent the law allows, we make no promise, express or implied, about the Site: not that its content is accurate, complete or up to date, not that it fits your purpose, not that it is free of errors or viruses, and not that Ozzie's answer is right. Smog check information is general guidance, and the sources cited on each page are responsible for their own figures. Nothing in these Terms limits any right you have under Nevada law in connection with work actually done on your vehicle at a location. Those rights are governed by the location's paperwork and Nevada law, not by this section. Some states do not allow certain disclaimers, so parts of this section may not apply to you. ## 14. Limitation of liability To the fullest extent the law allows, the company, its owners, staff and YelloPost are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or the cost of substitute services, arising from your use of or inability to use the Site or Ozzie, even if we were told such damages were possible. If, despite this section, we are found liable for something arising from the Site, our total liability to you is limited to the amount you paid us at a location for the service most closely connected to the claim in the 90 days before the claim arose, or, if you paid us nothing in that period, to one hundred dollars. This section does not limit liability for work done on your vehicle at a location, for personal injury or property damage caused by our negligence, for fraud, or for anything that cannot be limited under Nevada law. ## 15. Your responsibility to us If your breach of these Terms, your misuse of the Site, or anything you submit causes a claim against us or YelloPost, you agree to cover the reasonable costs, including attorney's fees, that result from it. ## 16. Governing law, venue and how disputes are handled These Terms and any dispute about the Site are governed by the laws of the State of Nevada, without regard to its conflict-of-law rules. Any lawsuit about the Site or these Terms must be brought in the state or federal courts located in Washoe County, Nevada, and you and we each agree to the personal jurisdiction of those courts. Nothing in this section stops either of us from bringing a claim in a small claims court that has jurisdiction. We do not require arbitration. If something goes wrong, we would rather hear from you first: email ian@xpressoilandlube.com or call the location, describe the problem, and give us a reasonable chance to fix it before anyone files anything. Most problems are solved with a phone call. ## 17. General terms Assignment. You may not transfer these Terms to someone else. We may assign these Terms to a successor that takes over the company or the Site, and we will post notice when that happens. Severability. If a court finds any part of these Terms unenforceable, that part is limited or removed to the minimum extent needed and the rest stays in effect. No waiver. If we do not enforce a term on one occasion, we can still enforce it later. Entire agreement. These Terms, the Privacy Policy and the Accessibility Statement are the whole agreement about your use of the Site. They do not replace the paperwork for work done at a location. Headings are for convenience only. Notices. Notices to us go to FMI Hudspeth, Inc. dba Xpress Smog Check Center, 4993 Longley Ln, Reno, NV 89502, or ian@xpressoilandlube.com. Notices to you go to the email address you gave us or are posted on the Site. Survival. Sections 9, 10, 13, 14, 15, 16 and 17 continue to apply after you stop using the Site. ## 18. Changes to these Terms We may update these Terms when the Site, the law or our practices change. The effective date at the top shows the current version. Using the Site after a change means you accept the updated Terms. If you do not, stop using the Site. ## 19.
